Municipal Court

The Andalusia Municipal Court is charged with hearing misdemeanor criminal and traffic cases that involve offenses committed within its police jurisdiction.

The Honorable William Alverson serves as the Municipal Judge. The primary function of the Municipal Judge is to hear all cases properly brought before the court and render a determination of each case heard.

Allen Woodard serves as the City Prosecutor and John F. Jones and Meredith Peters serve as Public Defenders.

The City employs a Court Clerk and a Magistrate to handle the daily operations of its Municipal Court. The general powers of a Magistrate include the issuance of arrest warrants, the granting of bail in minor misdemeanor prosecutions and the receiving of pleas of guilty in minor misdemeanor cases where a schedule of fines has been prescribed by rule. The Court Clerk is responsible for the day to day business and administration of the court.

Court Instructions to Defendant

If you are charged with any of the following, you may pay your fine before the Court Date by mailing your payment in full in the form of a money order or a cashier's check. You must also send your copy of the ticket with your signature on the back. NO PERSONAL CHECKS OR CASH ACCEPTED BY MAIL!!!

You may also wish to pay in person. The Municipal Court Office is located at 102 Opp Avenue.

If you fail to pay your fine before the Court Date, you must appear in court on the date and time written on your ticket.

If you enter a plea of "not guilty", or any other plea, you will receive a court order in Municipal Court of the date and time of your trial. If you are indigent and request a court-appointed attorney, and the Court is of the opinion that a conviction may result in a jail term as a part of your penalty, the Court will appoint an attorney to represent you without charge to you.

YOU MUST APPEAR IN PERSON ON YOUR COURT DATE AND TIME TO REQUEST A TRIAL, TO REQUEST A COURT APPOINTED ATTORNEY, OR TO MAKE ANY OTHER SPECIAL REQUEST.

Warrant and Cash Bond Information

How to Obtain a Warrant for Arrest:

A person must get a copy of an Incident/Offense Report from the Andalusia Police Department
The person wishing to obtain the warrant must give a written Affidavit at the Municipal Court Office.
A Magistrate at the Municipal Court Office will review the Affidavit and interview the person wanting to obtain the warrant.
Probable Cause will be determined by the Magistrate.
If Probable Cause is determined, a Warrant of Arrest will be issued by the Magistrate.
This Complaint and Arrest Warrant will be filed with the City of Andalusia Police Department.
The Warrant will be served by an arresting police officer.
Once the Arrest Warrant is served, the defendant may make proper bond which is stated on the Warrant for Arrest by the Magistrate.
Based on certain circumstances, special conditions of release may apply in addition to bail.

Cash Bond Information:

If the Judge orders it, a cash bond that has been posted for an individual may be held until all orders of the court have been satisfied. Any fines and costs may be ordered by the Judge to be deducted from the cash bond. A person should not post a cash bond, if he/she is not willing for the cash bond monies to be held for a period of time or if he/she does not want fines and costs deducted from the cash bond.

In the event that the court date is continued, said cash bond will be held over for the next court date.

In the event that the cash bond is ordered to be returned in full or in part, it will be in the form of a check from the City of Andalusia. The Municipal Court will only release the check to the defendant, but it could take several weeks for this check to be processed. Proper identification must be presented at the time the check is released. It is also the responsibility of the person posting the cash bond to provide the court office with written documentation in the event of a change of address or telephone number.

Traffic Citations

Defendants must have a citation number, must be paid in full and cannot be required a court appearance.
The system will not accept payments if an appearance is required.

Court Ordered Payment

Payment will be accepted only if the case(s) have been adjudicated with unsupervised probation.
Defendants must provide first and last name, last four digits of their social number, and a valid address.
